1. ACCEPTANCE OF TERMS
By installing, accessing, or using this application, software, or related services (“the App”), you agree to be bound by this Agreement.
If you do not agree, you must not use the App.
2. SCOPE OF APPLICATION
This Agreement applies to Seaworthy distributed through the Apple App Store and to its TestFlight beta (which involves no purchase).
Seaworthy is a boat maintenance logbook. The free tier supports one boat and five maintenance items in total. Seaworthy Pro is a one-time, non-consumable in-app purchase that unlocks the Pro features; it is not a subscription.
2.1 Global scope
This Agreement applies globally wherever Seaworthy is offered through the Apple App Store or TestFlight. The Publisher adopts the European Union General Data Protection Regulation (GDPR) and related EU law as its baseline standard and applies it as a global floor; mandatory consumer-protection and other statutory rights granted by the user’s country of residence remain unaffected and prevail wherever they are more protective.
3. LICENSE GRANT
Subject to this Agreement, the Publisher grants you a limited, non-exclusive, non-transferable, revocable license to:
- Use the App on devices you own or control
- Access and use functionalities according to intended purpose
For open-source components, the applicable open-source licenses shall prevail.
4. OPEN SOURCE COMPONENTS
The App may include open-source software.
- Such components are governed by their respective licenses
- This Agreement does not override or restrict rights granted under open-source licenses
- A list of open-source components shall be provided where required
You are responsible for complying with applicable open-source licenses.
5. RESTRICTIONS
You shall not:
- Reverse-engineer or decompile the App except where permitted by law
- Circumvent security or access control mechanisms
- Use the App unlawfully or in violation of third-party rights
- Redistribute proprietary components outside permitted scope
6. COMMERCIAL TERMS
Seaworthy can be used free of charge within the limit of one boat and five maintenance items in total. Seaworthy Pro (co.digitalfreedom.seaworthy.pro.lifetime) is a one-time, non-consumable in-app purchase, with no subscription, renewal or recurring charge. Its price is shown by the App Store at purchase.
Payments are processed through Apple’s StoreKit purchase flow. There is no direct payment route. See the Refund Policy and Legal Framework Overview for refunds and the seller of your purchase. Mandatory consumer rights remain unaffected.
7. USER RESPONSIBILITY
You are solely responsible for:
- All activities performed using the App
- All data processed, stored, or transmitted
- Compliance with applicable laws and regulations
Use of the App may result in unintended actions, including data modification or deletion.
8. DATA AND PRIVACY
Seaworthy stores boat records, maintenance items, logs, photos and documents on your device. When iCloud is available and enabled for Seaworthy, structured records sync through your private CloudKit database and files through iCloud Documents. Apple provides iCloud. The Publisher operates no user accounts and does not receive your logbook content through this sync.
Recognition and suggestions run on your device. The optional downloadable model is fetched from the Publisher’s Civo object storage; your photos and other inference inputs are not uploaded. See the Privacy Policy and Transparency Notice.
You are responsible for keeping appropriate backups and checking their completeness.
9. THIRD-PARTY SERVICES
The App may interact with third-party services.
The Publisher:
- Does not control third-party services
- Is not responsible for their availability or behavior
- Is not liable for damages caused by such services
Use of third-party services is subject to their terms.
10. DISCLAIMER OF WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND.
This includes, but is not limited to:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- ACCURACY OR RELIABILITY
- SECURITY OR AVAILABILITY
11. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PUBLISHER SHALL NOT BE LIABLE FOR:
- INDIRECT OR CONSEQUENTIAL DAMAGES
- LOSS OF DATA, PROFITS, OR BUSINESS
- SYSTEM FAILURES OR SECURITY INCIDENTS
TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE APP (IF ANY).
12. HIGH-RISK USE
The App is not intended for use in:
- Safety-critical systems
- Medical applications
- Financial trading systems
- Critical infrastructure
Use in such contexts is at your own risk.
13. INDEMNIFICATION
You agree to indemnify the Publisher against claims arising from:
- Your use of the App
- Violation of this Agreement
- Violation of applicable law
14. TERMINATION
The Publisher may terminate this Agreement at any time.
Upon termination, you must cease use and delete all copies of the App.
15. EXPORT AND SANCTIONS
You agree to comply with all applicable export control and sanctions laws.
16. GOVERNING LAW
This Agreement shall be governed by the laws of the State of Wyoming, United States of America, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.
Mandatory consumer protection laws of your country of residence remain unaffected.
17. REGIONAL PROVISIONS
17.1 European Union
- Mandatory consumer rights (including warranty rights) are not excluded
- Liability exclusions apply only to the extent permitted under EU law
17.2 United States
- Some states do not allow limitation of certain warranties or liabilities
- In such cases, limitations apply to the maximum extent permitted
17.3 United Kingdom
- Nothing excludes liability for death or personal injury caused by negligence
- Consumer Rights Act protections remain unaffected
17.4 Canada
- Consumer protection laws vary by province and may override parts of this Agreement
17.5 Australia and New Zealand
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:
- to cancel your service contract with us; and
- to a refund for the unused portion, or to compensation for its reduced value.
You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.
The notice above qualifies every warranty disclaimer and liability limitation in this Agreement and prevails over them. The guarantees attach to the Provider as supplier — Apple acts as the Provider’s agent in these territories, with Apple processing the payment. Section 64 ACL and s. 43 of the New Zealand Consumer Guarantees Act void any contracting-out.
17.6 Other Jurisdictions
- Where local law restricts provisions of this Agreement, such provisions shall apply only to the extent permitted
18. SEVERABILITY
If any provision is invalid, the remainder remains in effect.
19. APPLE APP STORE — ADDITIONAL TERMS
This section applies only to copies of the App acquired through the Apple App Store. Where it conflicts with any other provision of this Agreement, this section prevails for those copies. It reflects the minimum terms Apple requires of a developer who supplies its own end user licence agreement.
19.1 Acknowledgement. This Agreement is concluded between you and the Publisher only, and not with Apple. The Publisher, not Apple, is solely responsible for the App and its content.
19.2 Scope of licence. The licence granted to you for the App is a non-transferable licence to use the App on any Apple-branded device that you own or control, and as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
19.3 Maintenance and support. The Publisher is solely responsible for providing any maintenance and support services for the App. Apple has no obligation whatsoever to furnish any maintenance and support services in respect of the App.
19.4 Warranty. The Publisher is solely responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed. In the event of any failure of the App to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are the sole responsibility of the Publisher.
19.5 Product claims. The Publisher, not Apple, is responsible for addressing any claims relating to the App or your possession and use of it, including but not limited to product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation, including in connection with the App’s use of any framework for the management of health or fitness data.
19.6 Intellectual property rights. In the event of any third-party claim that the App or your possession and use of it infringes that third party’s intellectual property rights, the Publisher, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
19.7 Legal compliance. You represent and warrant that you are not located in a country that is subject to a US Government embargo or that has been designated by the US Government as a terrorist-supporting country, and that you are not listed on any US Government list of prohibited or restricted parties.
19.8 Developer name and address. Questions, complaints and claims relating to the App are directed to: DigitalFreedom Global LLC, 30 N Gould St, Ste N, Sheridan, WY 82801, United States · mailto:support@digitalfreedom.co.za · +1 307 451 0707 · https://support.apps.digitalfreedom.co.za
19.9 Third-party terms. You must comply with applicable third-party terms of agreement when using the App.
19.10 Third-party beneficiary. You acknowledge and agree that Apple and Apple’s subsidiaries are third-party beneficiaries of this Agreement, and that upon your acceptance of it Apple will have the right — and will be deemed to have accepted the right — to enforce this Agreement against you as a third-party beneficiary of it.
20. GOOGLE PLAY — ADDITIONAL TERMS
Seaworthy is not distributed through Google Play; this section is not applicable.
21. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between you and the Publisher.
It supplements the platform terms of the store the App was acquired from. Section 19 above takes precedence over conflicting provisions for App Store copies. The Legal Framework Overview states the order between the applicable legal documents.
BY USING THE APP, YOU AGREE TO THIS AGREEMENT.
