0. 適用範囲

本ポリシーは、買い切り型の非消耗型課金である Seaworthy Pro (co.digitalfreedom.seaworthy.pro.lifetime) の購入について、返金の取扱いを説明します。利用規約および EULA を補足するものです。Seaworthy にはサブスクリプションはありません。TestFlight での購入はテスト取引であり、課金されません。

Seaworthy は、対応する市場において Apple App Store および TestFlight を通じて提供されます。本ポリシーは世界共通で適用されます。提供者は、欧州連合の消費者権利指令（2011/83/EU）およびデジタルコンテンツ指令（(EU) 2019/770）を基本基準として適用し、さらに、それよりも手厚い保護を与える現地の消費者保護法（オーストラリア消費者法の法定保証、英国消費者権利法2015、米国の州法、ブラジル CDC など）を遵守します。

オーストラリアの消費者の皆様へ：

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

  • to cancel your service contract with us; and
  • to a refund for the unused portion, or to compensation for its reduced value.

You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

本ポリシーのいずれの規定も、これらの保証を制限しません。不具合が重大な場合、返金と交換のいずれかを選択する権利はお客様にあり、供給者である提供者が救済義務を負います。

1. 返金を取り扱う者

返金に関する権限は、お客様の購入における販売者に応じて決まります。

購入経路販売者返金の取扱い
Apple App Store（Seaworthy Pro の買い切り購入）EU/EEA、英国、スイスおよびトルコでは Apple Distribution International Ltd.。その他の地域では DigitalFreedom Global LLC であり、Apple は当社の代理人として行為しますいずれの場合も https://reportaproblem.apple.com の Apple の手続き。決済は Apple が処理します。当社が販売者である場合、お客様は当社に対して法定の権利を有し、第2条に手続きを示しています

当社は、Apple が行った課金を取り消すことができません。App Store の返金は Apple の手続きを通じて行います。お客様の購入における販売者が DigitalFreedom である場合、法定の返金および救済義務は当社が負い、ストアの裁量によるポリシーによって制限されることはありません。

Seaworthy は Google Play を通じて提供されていません。App Store の返金は Apple が処理します。販売者に対する強行法規に基づくお客様の権利は影響を受けません。

3. 直接購入

直接購入の経路はありません。Seaworthy Pro は App Store を通じて購入します。販売者は、Apple に適用される代理または問屋の取決めによって異なります。第1条および法的枠組みの概要第3条をご覧ください。

Apple が販売者である場合、Apple の撤回手続きが適用されます。DigitalFreedom Global LLC が販売者である場合、お客様は当社に対して法定の権利を有します。mailto:support@digitalfreedom.co.za までご連絡ください。App Store の課金の取消しは Apple が処理します。利用規約第7.5条に撤回の判断基準を定めています。

4. サブスクリプション

Seaworthy には、サブスクリプション、定期的な支払い、サブスクリプションの試用期間はありません。停止すべき更新もありません。

5. チャージバック

App Store の課金に異議がある場合、Apple の異議申立手続きまたはお客様の銀行の手続きをご利用ください。提供者は、正当な調査に協力します。取引が取り消されると、StoreKit を通じて Seaworthy Pro へのアクセスが取り消される場合があります。停止対象となる Seaworthy アカウントはありません。強行法規に基づく消費者の権利は影響を受けません。お困りの場合は mailto:support@digitalfreedom.co.za までご連絡いただけます。

6. 返金対象外の区分

Seaworthy は、消耗型の課金、サブスクリプション期間または第三者のコンテンツを販売していません。Seaworthy Pro の返金申請には第1–3条および強行的な消費者保護法が適用されます。本ポリシーは、追加の返金対象外区分を設けるものではありません。

7. EU のオンライン紛争解決

欧州委員会のオンライン紛争解決プラットフォームは、2025年7月20日に運営を終了しました。規則(EU) 2024/3228 により、同プラットフォームの設置根拠であった規則(EU) No 524/2013 は廃止されました。消費者は、mailto:hello@digitalfreedom.co.za に直接ご連絡いただくか、居住国の管轄の裁判外紛争解決機関に申し立てることができます。

DigitalFreedom Global LLC は、法律により義務付けられる場合を除き、ドイツ消費者紛争解決法（VSBG）に基づく消費者紛争調停機関（Verbraucherschlichtungsstelle）での紛争解決手続きに参加する義務も意思もありません。
